Dagan on Autonomy and Pluralism

Hanoch Dagan (University of California, Berkeley – School of Law) has posted Autonomy and Pluralism (Concise Encyclopedia of Fiduciary Law, Yifat Naftali Ben Zion & D. Gordon Smith eds., forthcoming) on SSRN.  Here is the abstract:

Fiduciary law is a wholesale legal category. It addresses a wide variety of deeply heterogenous legally-constituted or legally-facilitated frameworks. In this short entry, written for the forthcoming “Concise Encyclopedia of Fiduciary Law (Yifat Naftali Ben Zion & D. Gordon Smith eds.),” I argue that refining the distinctive contribution of fiduciary law to autonomy, while appreciating the diverse ways in which it manifests itself, is key to ensure the validity of learning and cross-fertilization across these fiduciary types.
