Smith, Howard & Edezhath on Charting the Gulf Between Artificial Intelligence and Judging

Todd Smith (Government of the District of Columbia), John Howard (Court of Appeals for the District of Columbia), and Ralph Edezhath have posted Charting the Gulf Between Artificial Intelligence and Judging on SSRN.  Here is the abstract:

This paper contributes to the understanding of the relationship between due process and the technical and theoretical limitations of current and future AI tools. The broad term, “AI tool” includes every kind of agentic workflow that calls any kind of autoregressive language model, and where identified, extends more generally to every kind of complex, computational model. It proposes an approach to identifying the environments within adjudicative workflows that admit high performing models without offending due process.
