Why are some feminist legal scholars hostile to analytic legal philosophy? Joanne Conaghan suggests it is because 'the analytical jurisprudential mind' screens out the relevance of gender in legal theory. I explain why this is incorrect. Contrary to common, but mistaken, beliefs, legal philosophy is sensitive to the changing nature of legal concepts, is alert to the ways values enter legal theory, and is aware of the importance of empirical studies in law. I illustrate this by examining some claims about the relationships between sex, gender, and marriage.
