Ever wondered the view of the judiciary in respect to the application of the doctrine of Judicial precedent? Why such strict adherence and disapprobation for the refusal to be bound by the rules of precedence. This paper attempts to provide an in-depth analysis of the application of the doctrine of judicial precedent, which will be used interchangeably with the term stare decisis. It undertakes a general overview of the adoption of this practice from English law and it’s impact on decision making in the Nigerian judicial system. The intent of this paper is to rest on a stand point that always to exist is the criticism against the strict application of the doctrine, however the principle has always and will continue to remain a significant part of modern adjudication.
