The Fundamental rights have evolved throughout the history with significant impacts of Renaissance, Industrial revolution and Digital revolution. With the emergence of age of Artificial Intelligence on the horizon, Fundamental Rights need to evolve as well once again. Constitution and Fundamental Rights constitute the bedrock and further rights can be built upon them. The Fundamental Rights should not be frozen in time and need to transmute in order to satisfy the contemporary needs of the people to realize their full potential, which gains significance when the development of AI is at such a stage where it is transcending from Weak and Narrow AI to Strong and General AI.
The authors would be analyzing the requirement of revisions to Part III of Constitution of India especially, Right to Equality under Article 15, Right to Freedom under Article 19, Right to Life and Liberty under Article 21 and Right to Education under Article 21-A in order to be in consonance with the emerging socio-legal landscape in the context of Artificial Intelligence. The authors would be further analyzing the need and structure of necessary legislations to further the goal of protection of the rights with focus on three pillars of ethics, privacy and security, and bring about their universal application in both public and private sphere.
