With the increasing tendency of federal jurisprudence to undermine statutory labor protections, employees in precarious, low-skilled jobs face mounting challenges in safeguarding their rights in the workplace. In particular, the proliferation of mandatory arbitration clauses and the federal preemption of state labor laws have deprived workers in New York City’s home care industry of meaningful avenues to address violations of labor law by their employers. These violations include wage theft and unpaid overtime work, sometimes spanning up to twenty-four consecutive hours. This report examines two such cases—Lai Yee Chan et al. v. Chinese-American Planning Council and Mei Kum Chu v. Chinese-American Planning Council—and seeks to elucidate the challenges workers encounter in defending their labor rights.
