Mark Geistfeld (New York University School of Law) has posted Product Liability Law in the Age of AI (Product Liability Law in the Age of AI (Aspen Pub. 3d ed. 2025)) on SSRN. Here is the abstract:
Although the title to this book has changed, this edition continues the developmental path staked out in the prior two editions of this casebook. When I began working on the liability issues involving the crashes of autonomous vehicles about a decade ago, I felt as if I were undergoing a comprehensive final examination on product liability law. Based on that experience, I incorporated problems on the liability issues for autonomous vehicles into the second edition of this book. My ongoing research into these matters naturally led to more broad-ranging inquiries into the liability issues involving artificial intelligence. This edition expands that line of inquiry and now includes over 50 review problems involving AI-related harms. For example, courts are starting to confront issues involving AI-related harms, including the predicate question whether software is a product or a service for tort purposes. Portions of that chapter are included here, along with the Table of Contents and related front-end materials.
