The scientific advances of recent years in the field of artificial intelligence have undoubtedly brought significant benefits to its users. However, alongside these developments, there has been a notable increase in the use of such technologies to commit criminal offences, particularly in the context of phishing and deepfakes. In this brief essay, without any claim to exhaustiveness, we aim to analyze one of these scenarios under Portuguese law, discuss the available legal mechanisms the State may employ to combat this phenomenon, and, ultimately, reflect on the need for legislative amendments in the criminal justice framework to keep pace with the scientific evolution of this technology.
