Justin Ko (University of Macau, Faculty of Law, Students; Harvard University – Harvard Law School) has posted Beyond East/West Constitutionalism on SSRN. Here is the abstract:
In this book, I attempt to deconstruct the false dichotomy between "Eastern" or "Chinese" constitutionalism and "Western" concepts of constitutionalism, specifically regarding ideals such as the separation of powers and judicial independence, by providing reference to a book on constitutional theory written by Harvard Law Professor Adrian Vermeule entitled "Common Good Constitutionalism." By highlighting key excerpts of the book, I argue that there are actually many commonalities between the Chinese, or Eastern, understanding of constitutionalism and Vermeule's "Common Good Constitutionalism" theory, which itself is derived from the common law and from the Roman law that serves as the foundation for the common law.
