Bruce Wilder (Wilder Mahood McKinley and Oglesby) has posted How to Amend How to Amend the Constitution: The easy ways, the hard ways, and the best way on SSRN. Here is the abstract:
The United States Constitution was a remarkable, and forward-looking achievement in its time. In all the years that have elapsed since then, there have been wide-ranging technological, social, and political changes in our society, of a magnitude likely unimaginable to the drafters of that document, yet our ability to accommodate for those changes by amending it has faltered badly, especially over the last hundred years. We seem helpless to prevent a series of consequences that threaten the democratic republic 1 the original document was meant, albeit imperfectly, to be as the embodiment of the ideals expressed in the Declaration of Independence. This article discusses those problems and proposes solutions.
