Narag on Feminist Jurisprudence & Consent

Diya Narag (OP Jindal Global University, JGLS) has posted Analyzing the Standard of Consent in Criminal Law in India: Through the Feminist School of Jurisprudence on SSRN.  Here is the abstract:

This article uses the feminist school of jurisprudence to analyze the standard of consent in criminal law, in India. It uses Catharine Mackinnon’s theory of domination to look at important jurisprudential questions like those of objectivity in court, if the current standard of consent is sufficient to adjudicate sexual assault cases, if our laws are truly victim-centric and what are the different legal reforms that are required to make justice an attainable goal for victims of abuse. It uses Mahmood Farooqi v. State as a contemporary case study to analyze the same.
