This chapter in the forthcoming OUP Handbook on the Use of Force addresses some hotly-debated points surrounding the use of armed force by peoples for their self-determination in recent years. While the practice of states is bent seemingly towards expanding the use of lawful force, e.g., to eradicate international terrorism, increased 'rights' to use force by states against non-state groups have simultaneously muddied the more traditional restraints placed on force when utilised domestically, during non-international armed conflicts against rebels and insurgents. This contribution examines these crucial restraints, long codified in humanitarian and fundamental human rights laws, which are placed on all parties to non-international armed conflicts, particularly those fought for self-determination.
